Use of Services

The Hospital Authority (“HA”) mobile application “18 CM Clinics” provides a portal for users to access the digital services of the Chinese Medicine Clinics cum Training and Research Centres (“CMCTRs”), manage patient-related information such as checking appointments made at the CMCTRs and perform tasks such as managing appointments (“Services”).

Using the Services

  1. By your downloading, accessing and/or using “18 CM Clinics”, you agree to abide by the Terms of Use, which may be amended from time to time without prior notice. The Terms of Use cover the terms and conditions described in:

    (a) the Use of Services;
    (b) the Disclaimer;
    (c) Copyright and Intellectual Property Rights;
    (d) Privacy Policy,
    which are applicable to all Services within “18 CM Clinics”; and Additional Terms for Specific Services, which contain additional terms that are applicable to a particular Service.

    Please read them carefully. If you do not agree to the Terms of Use, please do not download, access and/or use “18 CM Clinics”.

  2. You must follow any policies made available to you. Do not misuse or interfere with the Services or try to access them using a method other than the interface and the instructions that the HA provides. In particular, you agree not to use the Services to:
    (a) obtain or attempt to obtain unauthorized access to the HA’s servers, systems, network, or data;
    (b) make available viruses or any other computer code, files, programmes or content designed to interrupt, destroy or limit the functionality of the Services or affect other users; or
    (c) interfere with or disrupt the Services or servers, systems or networks connected to the Services in any way.

    You may use the Services only as permitted by law and regulations. The HA reserves the right to suspend or stop providing the Services to you:

    (a) if you do not comply with the Terms of Use or policies;
    (b) if the HA is investigating suspected misconduct;
    (c) if the HA is aware of or suspecting a breach of security or other suspicious circumstances relating to the use of “18 CM Clinics”;
    (d) if the HA is carrying out any maintenance (whether scheduled or not) of “18 CM Clinics”; or
    (e) at any time for any reason as determined by the HA at its sole discretion.

  3.  For query on any medical information on “18 CM Clinics” or if you are experiencing any discomfort, please seek advice from your Chinese Medicine Practitioners or other healthcare professionals.

  4. HA may allow you to access the publicly available content on “18 CM Clinics” or use some of the Services upon your installation of “18 CM Clinics”. However, you may need to provide your personal information for verification in order to use some of the Services, in particular those which involve access to your personal information or records.

  5. You are responsible for keeping your mobile device safe and secure. To safeguard the security of your mobile device, please take all reasonable precautions to keep your mobile device and your security information safe and prevent any unauthorized use. The precautions may include the following:

    (a) lock your mobile device and never write down or otherwise record your security information in a way that can be understood by someone else;
    (b) take care to ensure that no one hears or sees your security information when you use it;
    (c) ensure that your biometric credentials stored on your mobile device are your own and do not store anyone else’s biometric credentials on your mobile device and that you only use your own biometric credentials to unlock your mobile device;
    (d) do not use facial recognition for authentication purpose if you have an identical twin sibling, in which case you are recommended to use password to unlock your mobile device instead;
    (e) do not take any action to disable any function provided by, and /or agreeing to any setting of, your mobile device that would otherwise compromises the security of the use of your biometric credentials for authentication purposes (e.g. disabling “attention-aware” for facial recognition);
    (f) change your security information immediately if you know, or suspect, that someone else knows your security information;
    (g) if your personal information is displayed in “18 CM Clinics”, do not leave your mobile device unattended or let anyone else use your mobile device;
    (h) close “18 CM Clinics” once you have finished using the Services, and in particular do not leave “18 CM Clinics” running in the background whilst your personal information or record is displayed in “18 CM Clinics” (e.g. whilst multi-tasking, or running other apps).

  6. You must not use “18 CM Clinics” on any device or operating system that has been modified outside the configurations supported or warranted by the mobile device or operating system vendor(s). This includes devices that have been “jail-broken” or “rooted”. A jail broken or rooted device means one that has been freed from the limitations imposed on it by the mobile service provider and the device manufacturer without their approval. The use of “18 CM Clinics” feature on a jail broken or rooted device may compromise security and lead to unauthorized or fraudulent accesses. Downloading, accessing and/or using “18 CM Clinics” in a jail broken or rooted device is entirely at your own risk and the HA shall not be liable for any losses or any other consequences suffered or incurred by you as a result.

Modification or Termination of the Services

  1. The HA may from time to time:

    (a) change or improve the Services;
    (b) add or remove functionalities, modules or features within “18 CM Clinics”;
    (c) add, change or remove any type of “18 CM Clinics” membership scheme; or
    (d) add or impose new limits or restrictions to the Services.

  2. The HA may also in its discretion terminate, suspend or withdraw the provision of “18 CM Clinics” (or any part thereof) or a Service at any time without prior notice.

  3. You may stop using the Services and delete “18 CM Clinics” in your mobile device at any time.

Modification of the Terms of Use

  1. The HA may make changes to any information on “18 CM Clinics” including the Terms of Use at any time as it sees fit. Changes to the Terms of Use will be notified to you when you next launch “18 CM Clinics”. You are advised to check the Terms of Use of the latest version of “18 CM Clinics” every time you download, access and/or use “18 CM Clinics”.

  2. The HA may also notify you of additional terms that may be applicable to you when you download, access and/or use a new Service via the Additional Terms for Specific Services. If there is a conflict or inconsistency between the Use of Services and the additional terms associated with a particular Service as set out in the Additional Terms for Specific Services, the additional terms will prevail.

  3. The Terms of Use are governed and construed by the laws of Hong Kong SAR.

  4. The Terms of Use govern the relationship between the HA and you. The application of the Contracts (Rights of Third Parties) Ordinance is expressly excluded and no person who is not a party to the Terms of Use shall be entitled to enforce any right or term of the Terms of Use pursuant to the Contracts (Rights of Third Parties) Ordinance.

  5. Downloading, accessing and/or using “18 CM Clinics” will not create any other contractual relationship or any patient relationship between you and the HA. The HA is not obliged to follow up or contact you.

  6. Downloading, accessing and/or using “18 CM Clinics” will not create any other contractual relationship or any patient relationship between you and the HA. The HA is not obliged to follow up or contact you.

  7. The Terms of Use has been translated into Chinese. If there is any inconsistency or ambiguity between the English version and the Chinese version, the English version shall prevail.
